Dear Mr Draper and Mr Walker.

After a conversation between Mr Todd and Mr. Draper on Friday night, further advise was sort from the Supreme Court of NSW.

All further matters pertaining to the issues and investigation are to be addressed in writing. Please note the Trespass notice, acknowledge by Mr. Draper on Friday night, stands in effect.

Any agent, employee or person appointed by Integral Energy to assess, inspect, discuss, liase or communicate with Mr. Todd or any person associated with our company will be required to provide their background, a description of their technical expertise and no less than three commercially verifiable references. The references must meet our standard technical criteria for employment to our company. These details may be used in future court proceedings.

Upon directions from Mr. Draper on Friday afternoon and Friday night, we have assigned five engineers to operate on eight hour rotating shifts to monitor and manage resources at a cost of $99 per hour on shift and $33 per hour standby.

Simon made it abundantly clear, with numerous witnesses, that we should take whatever steps are necessary to ensure the continued operation where possible minimising costs. The Supreme Court concurs with this advice.

Mr. Todd did attempt, at great effort to minimise the need for 24 x 7 monitoring and shift rotation by requesting you make an immediate offer of compensation as would be necessary to return the operational infrastructure to the guaranteed standard it was at prior to your engineer attending the premise.

Mr. Todd indicated to Mr. Walker that the claim for compensation would be up to $30,000, based on restoration and replacement of resources whilst engineers were on standard activities up until Midday Saturday.

As arrangements have been necessary to extend beyond this time, and as authorised verbally by Mr. Draper, who also indicated that this claim was a very large claim that would grow until resolved, Integral will cover all costs required our company.

As Integral Energy has not been forthcoming, and in fact has been evasive and now un-contactable, we have no alternative but to maintain rotation rosters until such time as Mr. Todd indicates all resources are to a known quality and operational standard.

We note that Mr. Todd reports that in two conversations with Mr. Draper, that the Integral Engineer denies any interruption to the power supply at the time of his attendance. We note that Telstra records show interruption to all services.

We further advise that until such time as all resources meet the replacement and warrantee requirements of our suppliers and insurers, Integral Energy will be liable for claims of damages, loss of business, compensation and equipment failure.

We have made notices to the Supreme Court that a pending action will be commenced.

Based on the fact that standby engineers are available to remedy or rectify any faults or find other resolutions there is no need at this time to enter into interlocutory after hours proceedings.

However the Supreme Court does advise that our claim for standby costs will be valid and should be sought against Integral.

Mr. Todd indicates, pending his extended duty roster workload, that a full written report of all actives since 16:45 hours on Thursday 1 February 2001 until midnight 3 February 2001 will be available as soon as possible. The estimated cost of this report is $1900 including GST. This fee will be required to be paid by Integral prior to the report being provided.

We further understand the CEO, Mr. Richard Powis and General Manager Karen Waldon are yet to return calls to Mr. Todd from Friday.
